These Terms of Service ("Terms") govern your use of vysonmade.com and any purchase, quote, custom order or sign-up with Vyson Made, operated by Vyson Made, LLC ("we," "us," "our"). By using the site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.
1. Eligibility
You must be at least 18 years old to place an order, request a quote, subscribe to messages or create an account. By doing any of these things you confirm that you are 18 or older and able to enter a binding contract. If you order for a business or organization, you confirm you are authorized to bind it to these Terms. We may cancel orders or close accounts that do not meet this requirement.
2. Accounts
Keep your login details private and tell us right away if you think someone used your account without permission. You are responsible for activity on your account. Information you give us must be accurate and current.
3. Products, blanks and colors
- We try to show products, colors and sizes accurately. Screens display colors differently, and dye lots vary, so the color you receive may differ slightly from what you see online.
- Size charts are guides. Garment measurements can vary slightly between production runs.
- Availability can change without notice. If an item you ordered is out of stock, we will offer a substitute, a later ship date or a full refund for that item.
4. Custom orders: quotes, proofs and production
- Quotes. Quotes are estimates based on the information you provide and are valid for 30 days unless stated otherwise. Changes to artwork, quantities, garments, colors or placement may change the price.
- Artwork. You are responsible for sending artwork in a usable format. If your files need cleanup, separation or redrawing, we will tell you about any design fee before doing the work.
- Proofs. We send a digital proof for every custom order. Please check spelling, colors, size and placement carefully. Production starts only after you approve the proof and payment is received. Once you approve a proof, you accept responsibility for everything shown on it.
- Changes after approval. Once you approve a proof, the order goes into production and can't be cancelled, returned or refunded. Changes may not be possible and, if they are, may add cost and time.
- Normal variation. Screen printing and embroidery are hand-run processes. Small variations are normal and are not defects, including slight shifts in placement (up to about 1 inch), minor differences between ink colors and on-screen colors, ink texture, and thread color matching to the nearest available shade.
- Customer-supplied garments. If you provide your own garments, we will take care with them, but some loss is normal in production. We are not responsible for up to 3% spoilage, or for problems caused by the garment itself (for example, fabric that reacts to heat or ink). Please send extras.
- Turnaround. Production times on our Shipping & Returns page start after proof approval and payment. Rush service may be available for an added fee.
5. Pricing and payment
- Prices are in U.S. dollars. Sales tax is calculated at checkout based on the shipping address, as required by law.
- Payment is due at checkout for store orders. For custom orders, we may require a deposit or full payment before production; your invoice will say which.
- If a product is listed at the wrong price because of an error, we may cancel the order and refund you in full, even after you receive an order confirmation. We will tell you before charging a different price.
- We may refuse or cancel any order, for example because of suspected fraud, an age requirement not being met or content that violates section 8. If we cancel after you've paid, we will refund you in full.
6. Shipping, title and risk
Shipping times, delivery problems and lost or damaged packages are covered in our Shipping & Returns policy, which is part of these Terms. Title and risk of loss pass to you when we hand your order to the carrier, but we will still help you with carrier claims and replace or refund packages as described in that policy.
7. Returns, cancellations and refunds
All custom orders are final sale. We do not accept returns, exchanges or refunds on custom or decorated items once the proof is approved. If we make a production error, we will reprint the affected items as described in our Shipping & Returns policy, which also covers returns on blank items, order cancellations and refunds.
8. Your artwork and content
- You keep ownership. You own the artwork, logos and content you send us ("Customer Content"). You give us a limited license to use, copy, modify and reproduce it only to quote, proof, produce, ship and reorder your items.
- Your promises. You confirm that you own or have permission to use all Customer Content, including any trademarks, logos, characters, images, names or likenesses, and that printing it will not infringe anyone's rights or break any law.
- Content we will not produce. We may refuse any job, at our discretion, including content that we believe infringes intellectual property, is unlawful, defamatory or obscene, promotes violence or hate, or targets a person or group for harassment.
- Portfolio. We may photograph finished work for our portfolio and social media unless you ask us not to. See our Privacy Policy.
- Copyright complaints. If you believe something on our site or a product we made infringes your copyright, email info@vysonmade.com with the work, where you saw it, your contact details and a statement that you have a good-faith belief the use is not authorized.
9. Design services
When we create original artwork for you, you own the final approved artwork once the design invoice is paid in full, and we will provide the final files. Drafts, concepts you did not choose, and our general methods, templates and fonts remain ours. Third-party fonts or stock elements stay subject to their own licenses.
10. Our intellectual property
The Vyson Made name, logo, website design, photos, graphics and text belong to us or our licensors and are protected by law. You may not copy, reproduce or use them without our written permission, except to view and share pages of the site for personal, non-commercial use.
11. Newsletters, texts and subscriptions
- Marketing emails and texts are optional and sent only with your consent. You can unsubscribe at any time using the link in any email or by replying STOP to any text. Message and data rates may apply.
- If we offer a paid subscription or automatically renewing service, we will clearly show the price, billing frequency, renewal terms and how to cancel before you sign up. We will get your express consent, send you a confirmation, and give you an easy way to cancel online. You can cancel at any time before the next renewal.
12. Acceptable use
Don't use the site to break the law, interfere with its security or operation, scrape it with automated tools, upload malware, submit false information, or impersonate anyone.
13. Disclaimers
We stand behind our work as described in our Shipping & Returns policy. Apart from that and any warranty that cannot be excluded by law, the site and products are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some states don't allow these exclusions, so some of them may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from your use of the site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
You agree to defend and hold harmless Vyson Made, LLC and its owners and staff from claims, losses and costs (including reasonable attorneys' fees) arising from Customer Content you provide or your violation of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. If a problem comes up, please contact us first at info@vysonmade.com so we can try to fix it. Any lawsuit must be brought in the state or federal courts located in Duval County, Florida, and you and we consent to that venue. Either of us may bring a qualifying claim in small claims court instead. Nothing here takes away rights you have under the consumer protection laws of your state.
17. General
- Changes. We may update these Terms. The version posted when you place an order applies to that order.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a provision right away, we can still enforce it later.
- Entire agreement. These Terms, our Privacy Policy, our Shipping & Returns policy and any written quote or invoice for your order make up the whole agreement between us.
